  2. You can find everything you need to know about us, TLDC (UK) Limited trading as lights&lamps, and our products on our website before you order. We also confirm the key information to you in writing after you order, either by email or in your online account.

How to contact us. You can contact us by telephoning or writing to our Customer Service Team: https://lightsandlamps.com/pages/contact-us. Our customer service hours are between 9-5pm Monday-Friday excluding bank holidays and we will endeavour to respond to any enquiry within 48 hours. 

  1. How we may contact you. If we have to contact you we will do so by writing to you at the email address or postal address you provided to us in your order.

  3. We don’t give business customers all the same rights as consumers. For example, we don’t compensate them in the same way for losses caused by us or our products. Where a term applies just to businesses or just to consumers, this is clearly stated. You are a business customer if you are buying products wholly or mainly for use in connection with your trade, business, craft or profession, even if you are an individual.
  4. If you are a business customer these terms constitute the entire agreement between us in relation to your purchase. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by us or on our behalf which is not set out in these terms and that you have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.

  6. How we will accept your order. We will contact you using the email address you have provided to confirm we’ve received your order and to confirm we’ve accepted it. The order confirmation also serves as a proof of purchase.
  7. Sometimes we reject orders, for example, because a product is unexpectedly out of stock, because you are located outside the UK, or because the product was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid.
  8. We only sell to the UK. Our website is solely for the promotion of our products in the UK. Unfortunately, we do not accept orders from addresses outside the UK.
  9. We charge you when you order. You will own the product ordered once we have received payment in full.
  10. Payment methods. You can choose to pay with PayPal or using a credit or debit card. Payments are processed directly by Stripe or PayPal with secure encryption and under strict banking standards. We do not handle any credit or debit card details.
  11. If you are a business customer you have no set-off rights. All amounts due under this agreement (from you to us or from us to you) shall be paid in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
  12. We’re not responsible for delays outside our control

If our supply of your product is delayed by an event outside our control, we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won’t compensate you for the delay, but if the delay is likely to be substantial you can contact our Customer Service Team: https://lightsandlamps.com/pages/contact-us to end the contract and receive a refund for any products you have paid for in advance, but not received.

  1. OUR Products
  2. Our products can vary slightly from their pictures. We aim to display the colours of our products as accurately as possible. However, as resolution, print methods and screen settings can affect how an item is displayed, a product’s true colour may not exactly match that shown on your device or in our marketing. For any product made using natural materials such as marble, the appearance of the product may not exactly match that shown on your device or in our marketing. 
  3. All sizes and measurements indicated on our website are approximate but we try to make sure that they are as accurate as possible.
  4. Delivery 
  5. Delivery costs. The costs of delivery will be as displayed to you on our website during the ordering process.
  6. When we will provide the products. 
  7. In stock products. We will deliver products listed as ‘in stock’ to you as soon as reasonably possible.
  8. Pre order products. The product listing for products which are ‘pre order’ will include the estimated date on which the stock is to arrive at our warehouse. As soon as stock for pre order items arrives, we will process and despatch your order together with a dispatch notification email so you know to expect the delivery. 
  9. Any dates quoted for delivery of the products are approximate only.
  10. Failed or declined deliveries. We may charge you additional sums if products are rejected at the delivery address or returned to us due to multiple failed delivery attempts. 
  11. RETURNS for consumers: IF YOU CHange your MinD  
  12. If you are a consumer, we offer up to 30 days to change your mind about your purchase and receive a refund of what you paid for it (including standard delivery costs). This right is subject to the following conditions:
  13. The deadline for returning the product. If you change your mind about a product, you must let us know and return the product to us so that it arrives back at our premises no later than 30 days after the day we deliver your product. 
  14. Informing us. You must let us know you want to change your mind prior to making any return by contacting our Customer Service Team: sales@lightsandlamps.com or by completing the Order return form available on our website:  https://lightsandlamps.com/pages/returns-refunds.

  16. You have to return the product at your own cost. Returns are at your own cost. We advise that send the product back to us using an established, tracked delivery service. You should keep a receipt or other evidence from the delivery service that proves you have sent the product and when you sent it. If you don’t do this and we don’t receive the product at all or within 30 days from your receipt of the product, we won’t refund you the price.   17. We only refund standard delivery costs. For example, we don’t refund any extra you have paid for express delivery or delivery at a particular time.
  18. Condition of Product. To be eligible for a refund, the product being returned must be unused, uninstalled in its original packaging, in a resaleable condition and with its completed returns form and order number. Please note that if you handle the product in a way which would not be acceptable pre-purchase (for example removal of price tags or damage to packaging), we may reduce your refund, to compensate us for its reduced value.
  19. When and how we refund consumers. If your product hasn’t been delivered to you yet, we will refund you as soon as possible and within 14 days of you telling us you’ve changed your mind. If your product has been delivered and you are sending it back to us, we refund you within 14 days of receiving it back from you. We refund you by the method you used for payment. We don’t charge a fee for the refund.

  22. Consumer customers: If are a consumer, we honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. Our customer warranty does not affect a consumer’s legal rights if there is something wrong with a product.
  23. Customer warranty. We warrant that on delivery, and for a period of (i) 24 months from the date of purchase in respect of electrical faults and (ii) 12 months from the date of purchase in respect of non-electrical faults (warranty period), each product shall:
  24. conform in all respects with its description;
  25. be free from material defects in design, material and workmanship; and
  26. be of satisfactory quality (within the meaning of the Sale of Goods Act 1979).
  27. Informing us of warranty claim. 
  28. Please ensure you check all products on delivery. You must give us notice in writing within 7 days of receipt, and before any item is installed or fitted, of any fault or damage apparent on delivery which means the product does not comply with the customer warranty.
  29. You must give us notice in writing within 7 days of discovery, and during the relevant warranty period, of any electrical or non-electrical fault which means the product does not comply with the customer warranty.
  30. Remedies under customer warranty. Unless an exception applies under clause 8.5 (‘Exceptions to customer warranty’) if:
  31. you give us notice in writing in accordance with clause 8.4 above (‘Informing us of warranty claim’);
  32. you provide detailed images or a video of any damage or fault; and
  33. at our request, you return such product to us at our cost,

we shall, at our option, repair or replace the defective product, or refund the price of the defective product in full and this will be your only remedy for breach of the warranty (except for any consumer rights). These terms shall apply to any repaired or replacement products supplied by us.

  1. Exceptions to customer warranty. We will not be liable for a product’s failure to comply with the customer warranty if:
  2. where the fault is apparent on delivery, you install or fit the product;
  3. you make any further use of such product after telling us it is non-compliant;
  4. the defect arises because you failed to follow our oral or written instructions as to the storage, installation, commissioning, use, care or maintenance of the product or (if there are none) good trade practice;
  5. you alter or repair the product without our written consent; or
  6. the defect arises because of fair wear and tear, wilful damage or negligence.
  7. Our right to make changes
  8. Minor changes to the product. We may change a product:
  9. to reflect changes in relevant laws and regulatory requirements; or
  10. to make minor technical adjustments and improvements, for example to address a safety threat. These are changes that don’t materially affect the appearance or your use of the product.
  11. More significant changes to the products and these terms. We will notify you of any other change to the product or these terms and, should you wish, you can then contact our Customer Service Team: https://lightsandlamps.com/pages/contact-us to end the contract before the change takes effect and receive a refund for any products you’ve paid for in advance, but won’t receive.
  12. our responsibility for loss or damage suffered by you
  13. Losses we never limit or exclude. Nothing in these terms shall limit or exclude our liability for:
  14. death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);
  15. fraud or fraudulent misrepresentation;
  16. breach of the terms implied by section 12 of the Sale of Goods Act 1979; 
  17. defective products under the Consumer Protection Act 1987; or
  18. any matter in respect of which it would be unlawful for us to exclude or restrict liability.
  19. Our liability to consumers. Except in respect of clause 10.1 (‘Losses we never limit or exclude’), we are not responsible for the following losses you may suffer and which are caused by us breaking this contract:
  20. Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
  21. Caused by a delaying event outside our control. As long as we have taken the steps set out in clause 4 (‘We’re not responsible for delays outside our control’).
  22. Avoidable. Something you could have avoided by taking reasonable action. For example, damage to your property which was caused by a product we supplied and which you could have avoided by correctly following the installation instructions.

Our liability for any loss you suffer in connection with your trade, business, craft or profession is limited under clause 10.3 (‘Our liability to businesses’).

  1. Our liability to businesses. If you’re a business, then, except in respect of clause 10.1 (‘Losses we never limit or exclude’):
  2. we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and
  3. our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to one hundred and fifty per cent (150%) of the total sums paid by you for products under such contract.
  4. No implied terms about goods. Except to the extent expressly stated, we exclude all terms implied by sections 13 to 15 of the Sale of Goods Act 1979.

  1. Other important terms apply to our contract
  2. Resolving disputes. Our Customer Service Team: https://lightsandlamps.com/pages/contact-us will do their best to resolve any problems you have with us or our products.
  3. Governing law and Jurisdiction. These terms are governed by the laws of England and Wales. If you are a consumer then, wherever you live, you can bring claims against us in the English courts and if you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. If you are a consumer we can claim against you in the courts of the country you live in. If you are a business, you irrevocably agree to submit all disputes arising out of or in connection with our contract with you to the exclusive jurisdiction of the English courts.
  4. We can transfer our contract with you, so that a different organisation is responsible for supplying your product. We’ll contact you to let you know if we plan to do this. If you’re unhappy with the transfer you can contact our Customer Service Team: https://lightsandlamps.com/pages/contact-us to end the contract within 14 days of us telling you about it and we will refund you any payments you’ve made in advance for products not provided.
  5. You can only transfer your contract with us to someone else if we agree to this. However, you can transfer our customer warranty to a new owner of the product. We can require the new owner to provide reasonable evidence that you transferred the product to them.
  6. If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that any provision or part-provision of these terms is unlawful, it shall be considered deleted, but the rest of the terms will continue to apply.
  7. Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you’re not allowed to, but that doesn’t mean we can’t do it later.

These terms may have changed since you last reviewed them. We may revise these terms from time to time. Every time you order a product from us, the terms in force at that time will apply to the contract between you and us.
